OFFICIAL RULES 

NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. ODDS OF WINNING DEPEND ON THE NUMBER OF ELIGIBLE ENTRIES RECEIVED. VOID WHERE PROHIBITED BY LAW. 

ACCEPTANCE OF RULES: By taking part in the Giveaway, each entrant accepts and agrees to be bound by these Official Rules and the Promoter’s decisions, subject to applicable law. These Official Rules apply only to this Giveaway. 

PROMOTER: The Giveaway is promoted by New Era Cap Australia Pty Ltd (ABN 74 149 705 993), Level 1, 525 Flinders Street, Melbourne VIC 3000 (the “Promoter”). 

PROMOTIONAL PERIOD: The New Era 2026 NFL Melbourne Game Giveaway (the “Giveaway”) begins at 12:00:00 p.m. Australian Eastern Standard Time (“AEST”) on 1 September 2026 and closes at 11:59:59 p.m. AEST on 3 September 2026 (the “Promotional Period”). The Promoter’s computer is the official timekeeping device. 

ELIGIBILITY, RESIDENCY AND AGE: The Giveaway is open only to legal residents of Australia who are 18 years of age or older at the time of entry (each, an “Entrant”). Employees, officers, directors, representatives and agents of the Promoter and its parent companies, subsidiaries, affiliates, advertising or promotion agencies, and members of their immediate families or households are not eligible. The Giveaway is subject to applicable Commonwealth, state and territory laws and regulations. 

HOW TO ENTER THE GIVEAWAY: During the Promotional Period, the Promoter will publish a Giveaway post on its official Instagram account, @newera.aunz (the “Post”). To receive an eligible entry, an Entrant must: 

1. have a public or otherwise verifiable Instagram account;
2. follow @newera.aunz;
3. like the Post; and
4. comment on the Post and tag one (1) unique Instagram account belonging to another natural person.

ENTRY LIMIT: Each eligible comment tagging a different, unique Instagram account constitutes one (1) entry. Multiple entries are permitted, but duplicate tags, tags of businesses, brands, celebrities, bots, fake accounts or the same account more than once will not create additional entries. An Entrant may not tag a person without that person’s permission. Automated, programmed, robotic, bulk or fraudulent entries are prohibited and may be disqualified. No purchase or payment is required to enter. 

ENTRY RESPONSIBILITY: Entries must comply with these Official Rules and Instagram’s terms and policies. The Promoter is not responsible for lost, late, incomplete, invalid, unintelligible or misdirected entries, or for technical failures that prevent receipt of an entry. If there is a dispute about an entry, the authorised holder of the Instagram account used to submit the entry may be required to establish eligibility and account ownership. 

PRIZES AND APPROXIMATE RETAIL VALUES: Three (3) prizes will be awarded, with a total approximate retail value of AUD $2,100: 

PRIZE CONDITIONS: 

• The First Prize includes event tickets only. Travel, accommodation, meals, ground transportation, parking, taxes, insurance and all other costs associated with attending the event are not included and are the responsibility of the First Prize winner and guest.

• Event tickets will be delivered digitally to the email address nominated by the First Prize winner and are subject to the ticket issuer’s, venue’s, event organiser’s and applicable league rules and conditions. Seating location will be determined by the Promoter in its discretion. Tickets may not be resold, offered for resale, transferred for value or used for any commercial or promotional purpose. The winner and guest must comply with all applicable entry, security, conduct and health requirements.

• If the event is cancelled, postponed, relocated or materially changed for reasons beyond the Promoter’s reasonable control, the Promoter may provide any replacement, substitute or remedy required by applicable law and otherwise may substitute a prize of equal or greater value. The Promoter is not responsible for the winner’s or guest’s inability to attend.

• Each online voucher may be used only at neweracap.com.au, expires two (2) months after issue, may be used across one or more eligible purchases until its balance is exhausted, and is subject to the terms presented with the voucher. If an order exceeds the available balance, the winner must pay the difference using an accepted payment method. Vouchers are not redeemable for cash and any unused balance at expiry is forfeited, except as required by law.

• Prizes are not transferable, exchangeable or redeemable for cash, except as required by law. The Promoter may substitute a prize or component with one of equal or greater value if the advertised prize becomes unavailable for reasons beyond the Promoter’s reasonable control. Prizes are provided “as is”, subject to any rights and consumer guarantees that cannot be excluded under the Australian Consumer Law or other applicable law.

DRAW AND ODDS: A random draw will be conducted at 12:00 p.m. AEST on 4 September 2026 at the Promoter’s office at Level 1, 525 Flinders Street, Melbourne VIC 3000 or electronically under the Promoter’s supervision. Each eligible entry will have a random and equal chance of selection. The First Prize will be drawn first, followed by the Second Prize and Third Prize. Odds of winning depend on the total number of eligible entries received. Entrants do not need to be present at the draw.

WINNER NOTIFICATION AND CLAIMING A PRIZE: Potential winners will be contacted by Instagram direct message sent only from @newera.aunz within twenty-four (24) hours after the draw and will be asked to provide a valid email address. The Promoter will then contact each potential winner by official email to request reasonable information and documents needed to confirm eligibility and fulfil the prize, which may include full legal name, date of birth, residential address, telephone number and a signed Winner Eligibility, Liability and Publicity Release. Potential winners must respond to the initial direct message within twenty-four (24) hours and return any requested documentation within three (3) days after it is sent, unless the Promoter allows additional time. Winners will be advised in writing and prizes will be transferred within the period required by applicable law.

UNCLAIMED PRIZES AND RE-DRAW: If a potential winner cannot be contacted after reasonable efforts, fails to respond or provide requested information within the applicable claim period, is ineligible, declines the prize or otherwise fails to comply with these Official Rules, that potential winner may be disqualified and the prize may be awarded in a random re-draw from the remaining eligible entries. Any re-draw will be conducted at 12:00 p.m. AEST on 6 September 2026 at the same location and by the same method as the original draw, subject to applicable law. Any replacement winner will be notified by Instagram direct message and email using the same process described above.

VERIFICATION AND DISQUALIFICATION: The Promoter may verify the validity of entries and Entrants and may disqualify any Entrant who tampers with the entry or draw process, submits an entry not in accordance with these Official Rules, engages in unlawful or fraudulent conduct, or provides false or misleading information. The Promoter’s rights are subject to applicable law.

PRIVACY: The Promoter will collect, use, store and disclose personal information provided by Entrants and potential winners for the purposes of administering the Giveaway, verifying eligibility, contacting winners, delivering prizes, fraud prevention, recordkeeping and complying with law. The Promoter may disclose information to its affiliated companies, service providers, prize suppliers, ticket providers and regulators as reasonably necessary for those purposes. Unless an Entrant separately consents, personal information collected for the Giveaway will not be used for unrelated direct marketing. Entrants may contact the Promoter using the address above to request access to or correction of their personal information, subject to applicable law.

PUBLICITY: To the extent permitted by law, each winner consents to the Promoter using the winner’s name, Instagram handle, city or state/territory of residence, voice, image and likeness for announcing the result and for reasonable publicity relating to the Giveaway, without additional compensation. Any broader promotional use will be subject to the Winner Eligibility, Liability and Publicity Release and applicable law.

RELEASE AND LIMITATION OF LIABILITY: To the maximum extent permitted by law, Entrants release the Promoter, Instagram, Meta Platforms, Inc., the National Football League, participating teams, the event organiser, venue operator, ticket issuer, and each of their respective parents, subsidiaries, affiliates, officers, directors, employees, agents and representatives (collectively, the “Released Parties”) from claims arising out of participation in the Giveaway or acceptance or use of a prize, except to the extent caused by a Released Party’s negligence, wilful misconduct, breach of these Official Rules, or violation of a right or liability that cannot lawfully be excluded. Nothing in these Official Rules excludes, restricts or modifies any consumer guarantee, right or remedy under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law, or any other applicable law, where doing so would be unlawful.

TECHNICAL OR OTHER DISRUPTION: If the Giveaway is interfered with or cannot be conducted as reasonably anticipated because of fraud, technical failure, unauthorised intervention, force majeure or another cause beyond the Promoter’s reasonable control, the Promoter may modify, suspend, terminate or recommence the Giveaway, subject to applicable law and any direction from a regulator. If practicable, the Promoter may select winners from eligible entries received before the disruption.

PLATFORM AND LEAGUE DISCLAIMER: This Giveaway is in no way sponsored, endorsed, administered by or associated with Instagram, Meta Platforms, Inc., the National Football League, any NFL club, the event organiser, venue operator or ticket issuer. Entrants provide their information to the Promoter, not to Instagram or Meta. By entering, each Entrant releases Instagram and Meta from responsibility for the Giveaway to the maximum extent permitted by law.

GOVERNING LAW: These Official Rules and the Giveaway are governed by the laws of Victoria, Australia. Entrants submit to the non-exclusive jurisdiction of the courts of Victoria and courts entitled to hear appeals from them. Mandatory laws of an Entrant’s state or territory continue to apply.

WINNER INFORMATION AND RECORDS: The Promoter will publish or make available winner information only to the extent required by applicable law. The Promoter will maintain Giveaway records for the period required by applicable law.
